Regulation and Reasonable Prices in Brazilians Shipping and Port Sectors

Abstract: The economic order of the Brazilian Federal Constitution, stipulates that the State shall exercise the role of normative and regulating agent of economic activity and that the Public Power is obliged to maintain the appropriate service. The problem of research is the nonexistence of appropriate service, due to lack of appropriate regulation in the prices and tariffs of the sector of waterway transportation and ports by the National Agency for waterways and ports. The article analyses critically the regulations applied through some casess studies and concludes that the mentioned sectorial agency should take the leadership to proportionate reasonable prices to provide an appropriate service to the shippers, including the use of price cap (limitations to the price).
