Dr. Amit Mishra, Dr. Abhilash Srivastava

Abstract: This article critically examines the criteria for obscenity in law, exploring the challenges in defining and applying obscenity standards. It analyzes the tension between subjectivity and objectivity in assessing obscenity, the influence of cultural and contextual considerations, and the impact of technological advancements. Balancing freedom of expression and societal interests is a key focus, acknowledging the complexities surrounding the regulation of explicit content. The conclusion emphasizes the need for nuanced frameworks that consider harm - based approaches and evolving societal norms.
